Terms of Service

• You must be at least 18 to create an account.
• You must provide accurate information and keep your contact details up to date.
• You are responsible for keeping your password and any device that stays signed in secure. Notify us immediately at legal@trulyhomecabinets.com if you suspect unauthorized access.

You agree not to:

• Use the Service for anything illegal or to violate anyone else’s rights.
• Upload viruses, malware, or content you don’t have the right to share.
• Attempt to bypass authentication, rate limits, or security controls.
• Scrape, reverse-engineer, or copy substantial portions of the Service except as permitted by law.
• Impersonate another person or misrepresent your affiliation with a project.
• Use the AI assistant to generate harmful, abusive, or deceptive content directed at other users.

You keep ownership of the photos, messages, project details, and feedback you submit (“Your Content”). You grant TrulyHome a worldwide, non-exclusive, royalty-free license to host, store, display, and process Your Content for the sole purpose of providing the Service to you and the other people on your project.

You confirm that you have the right to share what you upload, and that it does not infringe anyone else’s intellectual property or privacy.

The Service is collaborative. Information you add to a project — including photos, messages, and damage reports — is visible to the other people assigned to that project (your TrulyHome rep, your ProPartner, the Elyon production team, and TrulyHome administrators).

Do not upload information that you would not want those parties to see. Treat messages and photos as business communications.

The TrulyHome app is currently provided free of charge to customers and ProPartners as part of the underlying cabinet purchase or contracting relationship. We will give advance notice in the app and by email before introducing any subscription or usage-based fees that affect you.

To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or perfectly secure.

The Service is not a substitute for a licensed installer’s judgment. Photos, progress updates, and AI assistant content are informational. Always rely on your TrulyHome rep, ProPartner, or qualified tradesperson for final installation decisions.

To the maximum extent permitted by law, TrulyHome and Elyon Cabinet Systems will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost data, lost profits, or business interruption. Our aggregate liability for any claim relating to the Service will not exceed AUD $100.

Nothing in these Terms excludes any rights you have under non-excludable consumer law (e.g. Australian Consumer Law).

You can stop using the Service and request account deletion at any time (see the Privacy Policy, §9). We may suspend or terminate your account, with or without notice, if you breach these Terms, behave abusively toward other users or staff, or use the Service in a way that creates legal risk for us.

Project records retained for warranty, audit, or legal reasons may survive account deletion as described in the Privacy Policy.

We may revise these Terms over time. If a change is material, we will give you advance notice by email or via an in-app banner. Continued use of the Service after the change becomes effective means you accept the revised Terms.
